Understanding the Probate Process
The Probate Department of the San Bernardino County Superior Court is the agency that oversees the probate process for local residents. The process will begin when a will is validated and a personal representative is approved. If the decedent passes intestate, or without a will, the court will need to appoint an administrator.

The probate process will consist of the following steps:

Assets will also include any pending payments owed to a decedent, such as retirement funds.

Addressing Debts – Probate proceedings will also deal with paying any taxes, expenses, and debts associated with the decedent's estate. Our firm can assist representatives in addressing, disputing, and paying debts.

Distributing Assets – Once debts have been addressed, remaining assets and property can be distributed according to the will. If there is no will, assets will be distributed according to California's intestate succession laws.
